Terms of Service

§1What ApeFax is

ApeFax (“ApeFax,” “we,” “us”) is a non-custodial, read-only forensic certificate service for NFT collections. The service launches with the Bored Ape Yacht Club (“BAYC”) collection; additional collections are added on a roughly monthly cadence, and the set supported at any time is listed on the site (“Supported Collections”). We generate computed reports (“Reports”) about individual tokens that summarize public on-chain history, ownership lineage, and marketplace activity, together with two separately-reported measures: a composite integrity score (the “ApeFax Score”) reflecting our detection of certain risk signals, and a distinct rarity measure. Rarity is reported on its own axis and does not alter the integrity score.

Reports are generated from public data sources (Ethereum mainnet, Bitquery, OpenSea, Alchemy, Etherscan, Dune, Gondi) and from our own analytical models. Certificate and card artifacts are issued under our AFG grading brand. Reports are informational only. They are not financial advice, appraisals, or trading signals. §2Eligibility & wallet authentication

You must be at least 18 years old to use ApeFax. By connecting a wallet you represent that you control the private keys for that wallet and that you are not a resident of a jurisdiction restricted by U.S. OFAC sanctions or similar restrictions.

Authentication uses Sign-In With Ethereum (SIWE). We never request, store, or transmit your private keys, seed phrases, or any signing material. Signing is performed in your wallet. We store only the resulting message signature and the wallet address. You may disconnect at any time.

§3Accounts & saved Reports

Connecting a wallet creates an account scoped to that wallet address. Reports you unlock or purchase are stored as snapshots tied to your wallet. A “snapshot” preserves the data and Score that was current at the moment of unlock — later changes to the underlying data do not retroactively change a saved snapshot.

If you lose access to a wallet, we cannot restore access to Reports unlocked from that wallet. Wallet recovery is your sole responsibility.

§4Payments

Payments are made in Ether (ETH) on Ethereum mainnet. We support raw-ETH transfers verified against the originating wallet, and (post-contract-launch) on-chain purchases through the ApeFax smart contract. Prices are displayed in ETH at the point of sale. We do not store payment-method credentials of any kind.

All sales are final at the moment of on-chain confirmation unless otherwise noted in §5. You are responsible for network gas fees, which are paid directly to Ethereum validators and never to ApeFax.

§5Refunds & failed transactions

If a payment confirms on-chain but the corresponding Report fails to deliver due to a fault on our side (data-source outage, scoring failure, internal error), contact support within 30 days for a credit or refund. If a Report delivers successfully, sales are final.

We do not refund for changes in the underlying on-chain data, marketplace activity, or score weightings after a successful delivery.

§6Reports & Fair Value disclaimer

The ApeFax Score, “fair value” estimates, “tier” labels, flag counts, and all derived signals are algorithmic estimatesproduced by our internal models using public data. They are not appraisals, not financial advice, not solicitations to buy or sell,and do not represent guarantees of market value, future performance, or authenticity beyond what is publicly verifiable on-chain.

Fair value is always a range, never a single promised price. Fair-value estimates are presented as a calibrated range (low — estimate — high) with a stated confidence label and, where available, the comparable on-chain sales used to derive them. Band widths are calibrated against our backtested prediction error, and we publish the measured coverage of the range — how often a realized sale lands inside it — together with median error on our methodology page. A range is a probabilistic estimate, not a promise: some realized sales will fall outside any honest range.

Where the underlying data cannot support an estimate — for example a token or trait with no usable comparable sales, or a degraded upstream data source — Reports display “insufficient data” (or a clearly-labeled, low-confidence indicative range) rather than a fabricated number. A missing input produces a degraded or withheld output, never an invented one.

NFT markets are volatile and illiquid. Two informed buyers can reasonably disagree on what any given ape is worth. ApeFax surfaces signals; it does not set prices. Decisions you make based on a Report are your own. Past activity is not predictive of future activity.

Score weights, model versions, and signal definitions may change over time as we improve the system. Each Report surfaces a methodology version identifier so you can tell which model version produced a saved snapshot.

§7Acceptable use

You agree not to:

  • Scrape, crawl, or systematically extract Reports or underlying data outside the rate limits we publish.
  • Resell, sublicense, or rebrand Reports as a paid product without prior written agreement.
  • Attempt to bypass the wallet-authentication or payment surfaces.
  • Use ApeFax in connection with fraud, market manipulation, money-laundering, or sanctioned activity.
  • Interfere with the operation of the service, our data sources, or other users.

§8Intellectual property

The ApeFax and AFG brands, certificate and card visual designs, scoring model, and analytical methodology are our intellectual property. Underlying on-chain data is public. You may share a single Report you have unlocked, and you may reference its Score or flags in third-party discussion, provided you do not strip our attribution and do not falsely imply endorsement by ApeFax of any transaction.

BAYC, MAYC, BAKC, and related trademarks are the property of their respective rights-holders. ApeFax is not affiliated with, endorsed by, or sponsored by Yuga Labs or any other rights-holder.

§9Disclaimers

ApeFax is provided “as is” and “as available”without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any Score or signal will be accurate.

Some jurisdictions do not allow disclaimers of implied warranties. To the extent those laws apply, this disclaimer is limited to the maximum extent permitted.

§10Limitation of liability

To the maximum extent permitted by law, ApeFax and its operators are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or lost opportunities, arising from your use of the service. Our aggregate liability for any claim relating to ApeFax shall not exceed the amount you have paid us in the 12 months preceding the claim.

§11Termination

We may suspend or terminate access for any wallet that violates these terms, or in response to legal process. You may stop using ApeFax at any time by disconnecting your wallet. Saved snapshots from a terminated wallet are retained per §5 of the Privacy Policy unless deletion is requested.

§12Changes to these terms

We may update these terms over time. Material changes will be announced on the site at least seven days before they take effect. Your continued use of ApeFax after a change indicates acceptance of the updated terms.

§13Governing law & contact

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Duval County, Florida.
